The New York Times has a story today about the case of Stacy Snyder, a 25 year-old mother of two that lost her job over a MySpace photo of her as a “drunken pirate”:

In the absence of strong protections for employees, poorly chosen words or even a single photograph posted online in one’s off-hours can have career-altering consequences. Stacy Snyder, 25, who was a senior at Millersville University in Millersville, Pa., offers an instructive example. Last year, she was dismissed from the student teaching program at a nearby high school and denied her teaching credential after the school staff came across her photograph on her MySpace profile. She filed a lawsuit in April this year in federal court in Philadelphia contending that her rights to free expression under the First Amendment had been violated. No trial date has been set.

Her photo, preserved at the “Wired Campus” blog of the Chronicle of Higher Education, turns out to be surprisingly innocuous. In a head shot snapped at a costume party, Ms. Snyder, with a pirate’s hat perched atop her head, sips from a large plastic cup whose contents cannot be seen. When posting the photo, she fatefully captioned her self-portrait “drunken pirate,” though whether she was serious can’t be determined by looking at the photo.

Millersville University, in a motion asking the court to dismiss the case, contends that Ms. Snyder’s student teaching had been unsatisfactory for many reasons. But it affirms that she was dismissed and barred from re-entering the school shortly after the high school staff discovered her MySpace photograph. The university backed the school authorities’ contentions that her posting was “unprofessional” and might “promote under-age drinking.” It also cited a passage in the teacher’s handbook that said staff members are “to be well-groomed and appropriately dressed.”

While there are probably a lot of people that don’t want their kids to be taught by a mother of two that posts “drunken pirate” party pics of herself to MySpace, it also seems ridiculous for Snyder to lose her job over a photo, that at worst, is unprofessional.

With more of us blogging, social networking, podcasting and video podcasting, there are probably going to be a lot more Stacy Snyders.

    As someone who doesn’t live in America, it always surprises me that in “the land of the free” these things continue to happen!! It is simply a form of totalitarianism that an employer can actively seek out internet content and then punish an individual because of it, and that individual then has to resort to private legal action to redress a wrong that has been done by the employer. This is what happens when you let your unions decline and the great Gods Money and Privilege rule the land. It is no wonder that people in the USA just pick up a gun and go berserk.

    Joe: In the “land of the free”, people may drink beverages out of plastic cups – in fact Macdonalds has made it the national sport to do so. People may also pose for photographs, and I expect half her students have their own myspaces and blogs, and some of them may have actually POSED FOR PHOTOGRAPHS.

    I wonder which branch of the Taliban you belong to, because that’s the attitude they have in Afghanistan, especially towards women. If your vengeful attitude comes from your belief in Jesus, I suggest you study your Bible a lot harder. Jesus would ask you if you would cast the first stone.

    Forgiveness is one of the big topics in the bible, Jesus died for our sins.
    Least you forget , the USA is not run by the laws of the bible , and therefore i hope she wins her case and makes people realize , its illegal to actually do such a thing to a person , a personal blog or website has nothing to do with work or school.

    I agree strongly with Ratbag. As an Air Force dependent, I’ve spent much of my life in the middle of other cultures and it sickens me to no point to find that most of the American society that is based on being able to have “God given freedoms”, is nothing but a huge lie.

    Joe, you are the biggest reason America stands within turmoil right now. Your faith is a beautiful thing, but at the same time you have to respect other people’s beliefs as well. Maybe she’s not Christian. We do have the right to make that choice on our own and it is NOT fair within the land that is known for religious tolerance for people like to walk around making people feel inferior for enjoying life. People such as yourself cause issues deep within our society and will ultimately be the reason that our empire fails. Nothing pleases you unless it’s in the bible, but guess what? We’ve got Muslims, Buddhists, Atheists, etc. all mixed in our society and we are forced to work with each one. Deal with it or go somewhere better because those of us who aren’t Christian are going to fight you till the death.

    I spoke about this case a few months ago on my podcast. She didn’t lose her job, she was kicked out of her program at school. Should would have been able to graduate, but they wouldn’t let her graduate with her license.

    The real problem for her was that she’s a teacher and this makes her both a public figure and a moral authority. It’s too bad she had to learn her lesson this way.

    Dave LaMorte, you contradict yourself. And you’re WAY off base! On the one hand you said she didn’t lose her job because she was a student; as if there were no professional penalty for her. And then you (correctly) point out that the University wouldn’t let her graduate with her certificate. If that doesn’t affect her job marketability, then I don’t know what will!

    Here’s what you said, just to refresh your memory:

    Note that in your first paragraph you make it sound like a slap on the wrist, and in your last paragraph you say that she IS a teacher! And strangest of all, you seem to be implying that because she would spend six to seven hours per day in front of a classroom full of H.S. students that she’s a “public” figure. Wrong! We’re all citizens FIRST, and our professions SECOND. The closest thing to a true “public figure” are our elected representatives. There is no question of “moral authority,” as you put it. She’s old enough to drink, and she did NOTHING illegal by going to a halloween party. There is nothing illegal about sharing pictures of yourself having a good (legal) time. If she were to post these items onto her blog during work hours, then THAT could be called unprofessional. What she does, or I do, or you do, behind our closed doors, on our own time is OUR business.

    And the notion that the school handbook calls for “professional attire” is ludicrous! Are they going to inspect your pajamas to make sure they’re “professional” when you go to bed? I hope she wins her case, and gets a massive judgement! Maybe then it will put a little fear into the institutions that seek to control us!

    I wouldn’t want my kids taught by someone who thinks it’s cute, funny, acceptable to be a “drunken” anything. Teachers are perfectly welcome to do whatever they want, I don’t care. BUT, when it shows up on a site that the children they teach WILL see, then that teacher will lose control and respect in the classroom.
    It’s not cute, funny, or entertaining to be drunk. It’s just stupid and a sign of much bigger problems.
    At her age, and being a parent, she should know better than to do something stupid like this. If she’s too stupid to understand discretion, she’s too stupid to teach.
    I know I wouldn’t allow my kids to stay in her class. Drinking is fine, drunkenness shows a lack of self control. If she can’t control herself, how can we expect her to control her class?

    No matter what her profession, our drunken pirate friend has the right to post whatever she wants on her MySpace without being bonked over the head by her employer. Do we think our kids are just THAT stupid? That they don’t know that adults drink alcohol and sometimes (read: often) take silly pictures of themselves when doing so? There is nothing in this photograph which points to an excessive consumption of alcohol, and even partnered with the caption, doesn’t show immoral or illegal behavior.

    As for being expected to wear professional attire, I agree with Eric. Is she not allowed to sleep in her underwear? Also, if she hadn’t been ‘drunk’ [allegedly] in the picture, would the pirate hat have been proper dress?

    Tina, mother of 2, your prissy and prim ideology has surely annoyed more than one authority figure associated with your poor children. She didn’t teach her students that it was *ok* to get drunk with this photograph. Also, assuming she can’t control herself is rediculous. You know nothing about this woman except that she may have consumed some or all of a (1, single) beverage which MAY or MAY NOT have been alcoholic at ONE POINT in her life.

I feel very sorry for this woman, because teacher or not she is put on a pedestal, and treated like an animal just because of an alcoholic drink, it didn’t even say that she was abusive or disorderly, just that she claimed to be a “drunken pirate” at a costume party.     Universities are the biggest hypocrites. They praise, invite, and almost drool over people that say anything and everything negative or treasonous to the USA and it’s people and military, give audience to psycho dictators (Pres of Iran, Hugo Chavez, etc.) and yet have the balls to fire someone because they are “adversely (negatively) affecting young people’s lives” or “encouraging young people to drink”. This is someone’s life outside work (none of their business).

    Now, with that said, don’t go whining about your “rights” when you make the private into the public. Life involves personal responsibility, restraint, and common sense. This woman had none of these. I may react differently if someone else posted the photo of a private party moment, but she did this stupid act herself.

Pulling Jesus out to made a point just drags him name through your dirt.     I think it is pretty hypocritical that she LOST HER JOB/CAREER over a PICTURE of her being a “drunk pirate” (something not necessarily determinable by the photograph) but all the other “role models” (actors/actresses, rappers/rocker/pop stars, professional athletes, socialites) continue to get paid BIG BUCKS despite their more-public-than-myspace antics. What kind of message does that send?

    Yeah on her part it was a STUPID thing to do, but seriously!, teaching was going to be her way of earning a living for her family. She’s undoubtedly spent lots of money, time, and effort to graduate and a PICTURE is going to cost her her career! That is outrageous!

    I teach, and I have to say that if you get fired for not being “well-groomed and appropriately dressed,” I hope no one runs into me at H.E.B. on Saturday morning.

    In all other regards, I think it was completely unfair that this happened, but unfortunately, it happens all too often. We need to let this one story slide, because there are too many others for this particular one.

    Also, as others have stated, there is nothing that proves that there was alcohol in that cup. and just because she’s making a face, doesn’t mean she’s under the influence.

    What the hell is wrong with you people, how did she ‘get what she deserved’? This is like blaming a girl for getting raped. She did nothing wrong. She is of legal age to drink, and she did so. Out of work. Where there’s nothing wrong with it.

    It shouldn’t even be an issue whether or not there was alcohol in the cup or whether or not she actually consumed any, because it’s her right to. It’s not even a stupid thing to do, she was having a good time.

    And damn, at 25, you’re still a kid. She’s been legal to drink now for 16% of her life. It’s still a novelty to her. And hey, it’s a hell of a lot better than a likely 75% of her students posting drunk pictures.

    Oh, and Tina: I’ll bet you $20 that your kids will have drank more than once by the time they are 18, regardless of how much you hound over them, what you do to try and stop them, or what you’ll do to them if you catch them.

When the government says alcohol is bad you say it is bad too, when the government says they are trying to make Iraq a democracy you believe them. I was born in Ukraine, but have lived in the US for 8 years. In Ukraine I have seen kids get drunk underage, and later they turned out to be fine adults. You can’t make your own choices if you don’t try them first(there are limits to this, like murder which is bad). I have tried smoking, it was terrible, I never tried again, I bet you if the drinking age was dropped to 15, kids would drink, but then they would find out what a hangover is and stop. Thats how it was done way before, and society was much better back then, so if you think, this teacher will make her kids drink she won’t, she was having fun, and that probably what your kids will do AS SOON AS THEY TURN 21. In addition, “morale clause”???? He had a right to drink, and I doubt many kids look up their teachers on myspace.     This happened at my Alma Mater.
    The article is misleading. It says that the Millersville Staff found the photo. What it doesn’t say is that they were directed there after Miss Snyder’s students found the photo of her. It also doesn’t tell you that she would go to student teacher dressed in shorts and a T-shirt. It doesn’t tell you that her Co-Operating Teacher had such a bad experience with Miss Snyder, that she may never take on a student teacher again. The Staff at Millersville gave us plenty of warnings about social networking pages, and websites, and making sure they were clean. The warning speech was included every semester before we started our Ed. Classes, and it was in every assembly that the Ed. Department held.

    While I can understand being upset that a mistake like this cost her so much, she and the newspapers refuse to publish the whole story, and I cannot condone her attempts to spread shadow over our Alma Mater for something that was essentially her own fault.

    But I fully agree that Stacy Snyder was fully trodden on, in regards to her right to due process and rights, as given by state and federal law (Bill of Rights, et al.)

    To wit:
    – Stacy was not given the proper due process to notify her of any instance of “unprofessional” conduct prior to MU’s action on stipping her of her BSE and expelling her from the Dept. of Education (where she worked as a student teacher).
    – Only the single photograph was offered as evidence, against which an entire 4-year study program (which she paid for with her hard-earned money and time) weighed. This photograph only portrays her holding a cup, wearing a simple pirate costume, and a caption (from the Myspace.com website where it was originally ‘found’) of “Drunken Pirate.” At most, this should have resulted in a warning from her MU adviser, and given her time to remove the apparently ‘offending’ content, and not instantly acting to expulsion and stripping of the BSE degree, which she was working towards.
    – Apparently, an out-of-court settlement was reached between Stacy and MU (look up the June 19, 2007 posting, see above link), and the subsequent posts appear to be Stacy’s attorney’s postings to remove the counts on the record (assuming the settlement was agreed-upon).

    I haven’t seen any newer developments on whether or not Snyder was reinstated to her BSE status, or whether she was able to continue her career as a PA-certified school teacher, so if anyone has any news on this, please put up the links.

    I am praying that Stacy and her family get the justice they deserve.

    This girl was punished for having a sense of humour. Stupidity has nothing to do with it. The caption “drunken pirate” is a simple quip because the girl is wearing a pirate hat and has a plastic cup in her hand, resembling a drunken pirate. Its fancy dress. Since when has fancy dress being a punishable stupitity? There is no evidence whatsoever that the girl is drunk, or even has alcohol in the cup. Pirates are associated with drinking rum, hence the fact light hearted caption.

    Even if she were drinking alcohol or drunk in her own time that is no ones business but her own. Nowhere in the teaching job spec does it state u must be tee total at all times. The only time you would have a right to complain/take action is if she is drunk when looking after the children. Buying, drinking and drinking too much are all legal activities. It is also not a crime to post humourous pictures of yourself on your myspace page.

    And please can you explain to me how a completely innocent photo/caption or drinking too much at a party proove that she cannot teach? The teacher I learnt the most from and subsequently did well in exams from, was a chain smoking, pot smoking hippy but his knowledge and passion for teaching was incredible. There was not a single member of our class that failed their exams in his subject, whereas the teachers that were strict and straight laced we generally didnt want to listen to them and subsequently did not do as well in their subjects.

This is of great assistance to the KKK and the Aryan brotherhood movement as the Yamakah & other Jewish headgear is easily identified and Anti semitic attacks can easily be carried out on these individuals without the fear of erroneously attacking a Muslim fundamentalist ally whose dream of wiping out Israel, and expelling the Jews from America is so closely alligned with the Aryan brotherhood & KKK causes. The folks who originated this policy should also have no difficulty getting Muslim extremists, The KKK or TheAryan brotherhood to hold rallys in favor of keeping the policy, as it brings us just 1 step closer to the Jew free campuses & workplaces that they have long dreamed of nationwide & even worldwide……….

    It is also intreresting that they have found a way to call all workplace orthodox Jews everywhere “unprofessional” and keep their jobs. Its worthy of the highest KKK & Nazi honors….. Borat would also be proud of their effort to rid schools and the workplace of Jews………..

    The morons who simply did not like the look of hats, or realize the implications of being on the same side aas KKK members, Nazis & the Aryan brotherhood, or that they could be providing evidence of their own possible membership in these organizations through the implementation & reccomendation that hats are unprofessional tend to back off pretty quickly when the they are informed of the racist aspects of no hats policy.
